Information Obligation of the Data Controller When Providing Personal Data – Contact Form

In connection with fulfilling the information obligations under Article 13 of the Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (hereinafter referred to as the “Regulation”), we inform you about the details below.

Natural and legal persons who have contacted the data controller via the contact form on the website https://ats-nitra.sk or through other means.

Which personal data do we process? These include basic identification data such as name, surname, contact details (email address, phone number), and the content of electronic communication.
We also inform you about data we process automatically – when visiting our website, we may collect certain information about you, such as IP address, the date and time of access to our website, information about your web browser, operating system, or your language settings. We may also process information about your behavior on our website, such as the links you visit. However, this behavioral data is anonymized for your maximum privacy, so we cannot associate it with a specific user or individual. If you access our website from a mobile phone or similar device or via one of our mobile apps, we may process information about your mobile device (data about your mobile phone, potential app crash logs, etc.). Please note that we use “cookies” on our website. Cookies are text files containing information that allows identification of frequent visitors only during their visit to our website. Cookies do not contain any personal data about you. The data controller collects cookies to record the total number of visitors in aggregated form, which helps improve and update the website and allows better navigation. Cookies, for example, allow the data controller to determine whether you have visited the website before or if this is your first time. We inform you that by submitting the contact form and consenting to the processing of personal data, you also consent to the use and collection of cookies. According to the Electronic Communications Act, such consent is also considered given if you use the appropriate setting in your web browser or other software. We only use cookies with your consent. You can prevent cookies from being used by enabling the private browsing function in your browser before visiting the website. However, this may cause some parts of the website not to display correctly, making it more difficult to navigate and preventing content from being displayed according to your needs.

Purpose of processing personal data:

This information system processes personal data of individuals who have contacted the data controller via the contact form available on the data controller’s

website. The data controller processes these personal data for the purposes of handling inquiries you have sent, responding to them, and subsequent communication with you.

Legal basis for processing your personal data:

Your personal data is processed under Article 6(1)(a) of the Regulation, i.e., consent to the processing of personal data for the above purposes, and Article 6(1)(b) of the Regulation (pre-contractual relationships): processing is necessary to take steps at the request of the data subject prior to entering into a contract.

Authorized employees of the data controller; Websupport, s.r.o. (domain management, web hosting, and email hosting).

Who do we provide your personal data to?

We do not provide your personal data to other entities, except in cases where we are required to do so by law.

Where is your personal data processed?

Your personal data is processed exclusively within the territory of the Slovak Republic.

Are your data used for automated decision-making?

Your personal data is not used for profiling or any other form of automated decision-making.

How long do we keep your personal data?

The data controller will immediately delete your personal data after the communication and pre-contractual relationships are concluded. In the case of entering into a contract, the data controller processes personal data in a different information system. If no contract is concluded, the data controller will delete the personal data without undue delay after the communication ends and the negotiation process is proven to be completed.

Withdrawal of consent:

If you have given us consent to process your personal data (the legal basis for processing some personal data is consent or explicit consent), you can withdraw your consent at any time through the contact details provided above. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

What rights do you have as a data subject?

  • Right of access to data: You have the right to obtain confirmation of whether your personal data is being processed. This right also includes access to these personal data and related information.
  • Right to rectification: You have the right to have your inaccurate, incomplete, or outdated personal data corrected or supplemented without undue delay, regardless of the reason for the inaccuracy.
  • Right to erasure: You have the right to request the data controller to stop processing and delete all personal data when the conditions set by the GDPR are met. This is especially applicable when users withdraw their consent or the purpose for processing the data no longer applies. Please note that even in such cases, the data controller is not obliged to erase your personal data if its processing is necessary a) for the exercise of the right to freedom of expression and information; b) to comply with a legal obligation, special regulation, or international agreement binding Slovakia; c) for public health purposes; d) for archiving in the public interest, scientific or historical research, or statistical purposes, where the right to erasure would make or seriously hinder the achievement of such processing goals; or e) for the establishment, exercise, or defense of legal claims.
  • Right to restriction of processing: In certain cases, in addition to the right to erasure, you also have the right to request the restriction of processing of your personal data, such as when the accuracy of personal data is contested, or if you object to the processing and wish to restrict its use until the legitimate grounds of the data controller are verified.
  • Right to data portability: You have the right to request the transfer of personal data processed in a structured, commonly used, and machine-readable format, and have the right to transmit this data to another data controller.
  • Right to object: You have the right to object to the processing of your personal data on the grounds of legitimate interest, including objection to profiling, and processing for direct marketing purposes based on legitimate interest. In such a case, we will no longer process your personal data unless we demonstrate the necessity of processing through a proportionality test.
  • Right not to be subject to automated decisions: You have the right not to be subject to decisions based solely on automated processing that significantly affect you. Your right includes the right to human intervention, to express your point of view, and to challenge such a decision. An exception applies if the decision is necessary for entering into or fulfilling a contract or is authorized by Union or member state law or based on explicit consent.
  • Right to lodge a complaint: You have the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection of the Slovak Republic.
